Grayson attorney files motion for new trial

File-Sean Grayson Photo: Sangamon County

Springfield, IL (CAPITOL CITY NOW) –  Daniel Fultz, attorney for former Sangamon County Sheriff’s Deputy Sean Grayson has filed a motion for a new trial and is asking for the 2nd degree murder conviction in the death of Sonya Massey to be thrown out.

Our news partners at WAND-TV report Fultz filed for the motion November 26th for multiple reasons including the judge’s rejection of a jury instruction that would have allowed jurors to consider if Grayson used deadly force to protect himself and the other officer.

One of the other reasons argues the court improperly excluded evidence about Massey’s behavior and mental state the day before the shooting occurred.

Fultz is still awaiting the court’s decision on the motion.

Grayson is scheduled for sentencing January 29th and could face up to 20 years in prison.
